MacKinnon ' s Theory • □ 南 茂 由利子 Nammo Yuriko □ 大阪女子大学 この 論文 に アクセス する • 外部 サイト この 論文 を さがす • NDL ONLINE • CiNii Books 著者 • □ 南 茂 由利子 Nammo Yuriko □ 大阪女子大学 抄録 アメリカ合衆国 の 著名 な 法学 者 キャサリン ・ A ・ マッキノン の 提起 する フェミニズム 理論 を 検討 する 。 まず 、 彼女 の 最 重要 課題 が 、 セクシュアリティ における 平等 で ある こと を 明らか に する 。 マッキノン は 、 現在 の セクシュアリティ 概念 自体 が 男性 優位 社会 の 構築 物 で ある として 、 新た な セクシュアリティ 概念 の 構築 を 主張 する が 、 その 具体 的 な 内容 は 示さ ない まま で ある 。 本稿 は 、 それ が マッキノン 理論 の 根本 的 問題 に 由来 する と 捉え て 、 その 克服 方法 を 考察 する もの で ある 。 根本 的 問題 と は 、 生殖 の 社会 性 という 視点 の 欠落 と 、 性別 以外 の 社会 的 関係 の 無視 で ある 。 それら を 土台 と する マッキノン 理論 は 、 「 人種 」 、 民族 、 階級 等々 の 社会 関係 に 規定 さ れ て いる セクシュアリティ の 現実 を 変革 する 具体 的 ヴィジョン を 示す こと も でき ない 。 男女 平等 を めざす にあたり 、 性別 を 理由 と する 不 公正 を 正す うえ で 、 セクシュアリティ 追究 の 平等 を 中心 に 据える 彼女 の 姿勢 は 、 性別 以外 の 人間 の 社会 的 諸 関係 を 捨象 し た セクシュアリティ 中心 主義 と も いう べき も の で ある 。 それ は 、 性別 に 限ら れ ない 諸 関係 の 中 に 位置づけ られ て 生き て いる 女性 達 の 現実 を 打破 する 思想 ・ 運動 の 中心 課題 に は なり え ない 。 マッキノン は 、 私的 領域 が 女性 抑圧 の 温床 と なる こと が 避け られ ない として その 廃止 を 提起 する 。 それ が 誤っ た 現状 認 識 に 立つ 危険 な 提起 で ある こと を 、 本稿 は 論じ て いる 。 ファリダ・アクター を 主たる 参 照 先 と し ながら 、 公 ・ 私 二 領域 論 によって は 社会 の 構造 と 人 の 営み を 捉え 得 ない こと と 、 マッキノン の 提起 が 人 の 営み を 国家 が 統括 する 法 の 監視 に さらす 危険 を 孕む こと を 明 ら か に する 。 近代 以降 広範 に 浸透 し た 公 ・ 私 二 領域 論 を 克服 する ため に は 、 人間 存在 の 二 重 性 を 再 認識 し 、 「 個 」 を 社会 的 に 埋没 さ せる こと の ない 民主 的 な 社会 関係 の 創造 と ともに 、 従来 の 公 ・ 私 二 領域 という 二元論 を 超える 新しい イデオロギー の 創造 が 必要 と さ れる 。 This paper examines the arguments and attitudes expressed in the development of feminist theory constructed by Catharine A . MacKinnon . She is one of the most famous legal scholars in the United States . First , I show that her chief concern is the pursuit of equality in sexuality . MacKinnon requires that sexuality itself be transformed because she identifies sexuality as a construction in a male supremacist society . She does not , however , indicate how to transform sexuality and what conception of sexuality she wants to form . Why does not she address these issues ? I argue that this is due to fundamental problems with her attitudes , and I seek a way of solving these problems . The fundamental problems with MacKinnon ' s attitudes are the failure to view reproduction as a primarily social activity , and the ignoring of social relationships other than those that are sexual . Because of these flaws in the foundation of MacKinnon ' s theory , she is unable to present a concrete vision of how to transform the sexual realities that are conditioned by the social relationships of race , ethnicity , class , and so on . I call her approach , which focuses on the pursuit of equality in sexuality while discarding all other human relationships , a " sexuality - centered approach ." It does not deal with the main subject of feminism , which is challenging the realities that women have faced in various social relations that include sex but are not limited to sex . MacKinnon proposes the abolition of the private sphere because it can foster the oppression of women . This paper argues that this is a dangerous proposal considering her misunderstanding of the reality . The dualism of private and public spheres does not sufficiently encompass the reality of social constructions and human activities . By mainly referring to the writings of Farida Akhter , MacKinnon ' s proposal exposes us to the risk of having every part of our lives placed under state control . To overcome the dualistic theory of the private and public spheres that has become so widespread since the advent of the modern era , it is necessary to once again recognize the duality of human existence and to create democratic social relations that will not bury the individual .
